Oversight Project Unveils Post-Ruling Immigration Blueprint, Eyes Hospital Enforcement and China Birth-Tourism Crackdown

The Oversight Project, a conservative government watchdog, published a multipoint immigration enforcement plan after the Supreme Court ruled 6-3 to affirm birthright citizenship as enshrined in federal law. Mike Howell, the group's attorney and president, framed the response around accelerated deportations and structural enforcement measures rather than a direct legal reversal. The White House said President Trump has directed Congress to take immediate action while the administration doubles down on border enforcement.

The court's majority included Chief Justice John Roberts, Associate Justices Amy Coney Barrett and Brett Kavanaugh, and the court's three liberal justices — a alignment that drew immediate criticism from conservatives who argued the decision opens citizenship pathways for children born to foreign nationals unlawfully present in the United States. Roberts, a George W. Bush appointee, has drawn recurring Republican ire for serving as a swing vote toward the court's liberal minority, most notably in the 2012 NFIB v. Sebelius decision that upheld the Affordable Care Act's mandate as a tax.

Howell's Enforcement Blueprint

Howell's "Keeping Families Together Plan," shared with Fox News Digital, centers on the argument that the ruling conferred no legal status on parents. He called for worksite enforcement sweeps targeting farms and factories over piecemeal arrests in sanctuary cities, and suggested positioning ICE agents at specific hospitals to intercept birth-tourism cases. Howell also proposed using the congressional reconciliation process to impose a financial penalty on birth tourists — structured, per the Oversight Project's plan, as a tax in the mold of the ACA ruling to survive constitutional review.

China Identified as Primary Birth-Tourism Source

Howell identified China as the largest source of organized birth tourism, describing schemes in which wealthy Chinese nationals arrange for children to be born on U.S. soil. He said leverage exists in China's elite access to U.S. financial markets and that the administration should use that access as a negotiating instrument, including suspending visas for countries engaged in birth-tourism practices. The DOJ, according to White House spokesperson Abigail Jackson, will make birth-tourism prosecution a priority.

Congressional Moves and Deportation Tallies

Rep. Andy Ogles IV, R-Tenn., and Sens. Eric Schmitt, R-Mo., and Rand Paul, R-Ky., have introduced constitutional amendment proposals to overturn the ruling, though observers characterize the efforts as politically untenable in the near term. A DHS spokesperson said the agency disagrees with the ruling and is pressing Congress to act, citing over 948,000 deportations and more than 981,000 arrests since Trump took office, with an estimated 2.2 million additional self-deportations and a total of more than 3 million departures. Howell acknowledged the mass-deportation campaign has not matched stated ambitions, pointing to workforce lobbying pressures and enforcement hesitancy as drags on the numbers.
